With assistance of the High Commissioner for Human Rights in Russia criminal proceedings related to an unlawful sale of the apartment of convict P. have been initiated. The above was reported in the official reply of the Prosecutor’s Office of Rostov Region to the request of the High Commissioner.
In March 2016, the High Commissioner received a complaint from convict P., who served sentence in a correctional colony of Krasnodar Territory. In August 2015, the complainant found out that her apartment she owned had been sold by a power of attorney allegedly signed by her, while P. had not signed any. The complainant repeatedly appealed to competent authorities for help, but her request to initiate criminal proceedings was constantly refused.
Having analyzed the situation, the High Commissioner petitioned the Prosecutor’s Office of Rostov Region to examine the information set out by the complainant.
The Prosecutor’s examination initiated by the High Commissioner confirmed that the complainant had become a victim of fraudsters. The Prosecutor’s Office has initiated criminal proceedings under Article 159 Clause 3 of the Criminal Code of the Russian Federation (a fraud). At the present time the criminal case is being preliminary investigated to establish all facts of the unlawful sale of the apartment.
