Dialogue with High Commissioner. Protection of housing rights

Article 40 of the Constitution of the Russian Federation provides that everyone shall have the right to a home, and local self-governments shall create conditions for exercising this right.

Citizen M. appealed to me for non-execution of the judgement by local self-government. Her house burnt down in 2010 and she must have received a living accommodation out of turn as she lived with two children of tender years.

Being in fact homeless, she had to stay overnight with her friends, acquaintances and relatives for more than 5 years. If it had not been for good attitude from the part of not indifferent people, she could have been on the street at any moment.

On behalf of the applicant I addressed a motivated compellation to the Prosecutor Office of the Leningrad Region.

According to the received answer, in April 2016, the administration of the Vyborgsky district suggested to purchase an accommodation to get it into municipal property. LLC «LAD» sent its request which was held suitable to the demand. In its turn, the draft contract regarding the municipal house-buying for M. and her family members was addressed to the Commission of Control and Account of the municipal settlement the Vyborgsky district. The conclusion of the abovementioned contract is monitored by the Prosecutor Office of the city of Vyborg.

According to the information provided by the Vyborg Prosecutor Office, subject to contract conditions, M. and her family comprising 3 members have received a living house that is 62,4 square metres in area.

The present example is not the only one in my practice. I regularly receive similar appeals but each of them is unique.

I would like to hope that local governments will hereafter pay more attention to the problems of single mothers and all judgments will be executed in proper time.
