High Commissioner for Human Rights in the Russian Federation Tatiana Moskalkova received a complaint from S. about the unlawful, in the applicant’s opinion, refusal to initiate criminal proceedings on the application of material damage from officials during the demolition of the garage belonging to him, as well as causing damage as a result of violation of order and conditions of storage of property.

Having familiarized herself with the materials submitted, the High Commissioner sent an appeal to the Prosecutor’s Office of the city of Moscow with a request for verification of the circumstances stated above.

According to the response, the decision to refuse to open a criminal case was quashed, the fact of violation of Article 6.1 of the Criminal Procedure Code of the Russian Federation was found, a requirement was made to eliminate violations of the law.
