Thanks to High Commissioner the prisoner released from custody

On July 3, as a result of assistance of the High Commissioner for Human Rights in Russian Federation, lawyer Vladimir Zubkov was released from custody.

As a result of media monitoring, the federal ombudswoman became aware about the violation prisoner’s rights. On July 2, the newspaper «Kommersant» published an article named «Cancellation of Sentence is Not a Reason for Release», which reported about failures by the Federal Penitentiary Service of Russia to enforce court decisions on the release of citizens from custody.

The publication provides information that after the cancellation by the Kostroma regional court of the conviction against Vladimir Zubkov held in Yaroslavl prison, he was not released for four days despite the court’s decision to choose a preventive measure in the form of travel restrictions.

The High Commissioner sent corresponding request to the Prosecutor General’s Office of the Russian Federation. As a result, on July 3, the citizen was released.

Tatiana Moskalkova is aware of the practice of long-term non- enforcement by the Federal Penitentiary Service of Russia of court decisions involving the release from custody of persons held in places of deprivation of liberty.

«This problem is systemic», Tatiana Moskalkova considered.

According to the federal ombudswoman, similar facts are reported by Commissioners for Human Rights in the constituted entities of the Russian Federation. For example, in the Nizhny Novgorod Region the term of execution of such court decisions reaches up to 7 days.

«I would like to note the role of the Prosecutor General’s Office of the Russian Federation, which promptly takes measures to respond to such situations. The developed condition is due to objective reasons related to the delivery of court decisions to institutions of the Federal Penitentiary Service of Russia located at a great distance», Tatiana Moskalkova explained.

However, according to High Commissioner, given the current level of technical development and digitalization of all spheres of public relations, including criminal proceedings, in which the possibility of remote participation in the court session is provided, it would be correct for such important court decisions concerning release from custody to be sent via secure communication channels.

«In this regard I am preparing proposals to amend the relevant regulatory legal acts», the federal ombudswoman said.
