With assistance of the High Commissioner for Human Rights in Russia gross errors in a suspect’s letter of reference were corrected. An explanatory work was conducted in order to prevent the same situations.
As a result of the High Commissioner’ petition to the Prosecutor’s Office the violations in two municipal units of the Republic of Bashkortostan caused by conflicts of interests have been revealed and eliminated.
Having considered administrative judgment of the High Commissioner for Human Rights in Russia, the Presninskiy District Court of Moscow City remedied housing rights of K. belonging to the category of orphans. The decision of the Moscow Interdepartmental Commission to refuse to provide K. with housing recognised as unlawful. The case will be reconsidered.
After the High Commissioner for Human Rights in Russia had appealed to the Prosecutor’s Office of Saratov Region the right of citizen G. to access to justice was restored. The red tape was eliminated and a criminal case against a dishonest director of a utility company was launched. The above was reported by the Prosecutor’s Office of Engels in the official reply submitted to the Office of the High Commissioner.
With the assistance of the High Commissioner for Human Rights in Russia a criminal investigation into fraud has been launched. Therefore, the right of elderly disabled woman S. to access to justice has been restored.
After interference of the High Commissioner for Human Rights in Russia the rights of a Bashkortostan resident to fair court hearing was restored.
On 28 July, the Ostankinskiy District Court of Moscow granted a judgment to an orphan girl and held that she must be provided with housing from the specialised residential fund of Moscow. That was the result of the High Commissioner’s request sent to the Judicial Chamber on Civil Cases of the Supreme Court of the Russian Federation. The Supreme Court has reversed previous judgments in the case and has forwarded the case to the court of the first instance.
After interference of the High Commissioner for Human Rights in the Russian Federation the order to suspend investigation into the criminal case about a road accident, which caused death of a man, has been revoked and the case given back to be investigated additionally. It was reported in letter of reply received from the Novgorod Prosecutor’s Office in July.
Law on state cadastral valuation elaborated with assistance of High Commissioner enters in force in 2017
The Federal Law On the State Cadastral Valuation signed by the President of the Russian Federation on 3 June 2016 took into account several remarks and proposals of the High Commissioner for Human Rights in the Russian Federation. The law enters in force in 2017.
With the assistance of the High Commissioner the right of a citizen of Adygea to judicial protection has been reinstated. On 28 July, the Presidium of the Supreme Court of the Republic of Adygea vacated the ruling of the Tahtamukaysky District Court and the decision of the Judicial Chamber on Criminal Cases of the Supreme Court of the Republic of Adygea. The action was withdrawn for the absence of elements of a crime.
