Thanks to High Commissioner, debtor's rights restored

Through the media High Commissioner for Human Rights in the Russian Federation Tatiana Moskalkova became aware of the plight of 72-year-old low-income pensioner V., resident of the Trans-Baikal Territory.

In connection with the enforcement of the court decision on recovery of debts for public utilities, court bailiffs-executors decided to recover the debt out of the debtor’s pension in full, without observing the restrictions provided for in Article 99 of Federal Law No. 229-FZ «On Enforcement Proceedings».

In desperation from the situation, the applicant appealed to the President of the Russian Federation Vladimir Putin, pointing to his lack of other income except for his pension and the opportunity to purchase food and medicine.

Tatiana Moskalkova sent an appeal to the Trans-Baikal Territory Prosecutor’s Office with a request to verify the circumstances and take measures to restore the rights of V.

As a result of the audit, violations of the law «On Enforcement Proceedings» were proved. Moreover, the debtor’s right to timely acquaintance with the executive document was violated. The money was returned to the account of V., in addition, an official check was carried out against the staff member who committed the violation of the pensioner’s rights.
