Law contravenes principle of justice

On 19 December, Mayor of Moscow Sergey Sobyanin granted the petition submitted by the Commissioner for Human Rights in Russia related to the support of a low-income family of Mr M., as an exception.

Pursuant to the Mayor’s decision, the disabled person and veteran of labour Mr M., who has two dependent minor grandchildren, has been provided with a dwelling under a lease contract, and, in addition, the family will retain their right to be on the books of persons in need of housing.

Previously, the court had lawfully held that the elderly person be evicted from the one-room flat which he had occupied without permission together with his two grandchildren. However, taking in consideration the complicated life situation, the Commissioner considered it possible to apply to the Mayor of Moscow, since the requirements of law in this situation contravened the principles of justice.
