High Commissioner obtained a review of criminal case

27 December 2017

The High Commissioner for Human Rights in the Russian Federation was addressed by the convicted B. with a complaint about a violation of his right to a fair trial.

In September 2016, citizen B. was convicted and sentenced to imprisonment for 8 years, with serving a sentence in a strict regime colony. B. appealed the decision, but the court of appellate instance left the verdict unchanged.

According to B.'s arguments, the courts of the first and second instance admitted significant violations of the rules of the criminal and procedural legislation that affected the outcome of the case.

Having familiarized herself with the materials submitted, the High Commissioner sent a request to the presidium of the Stavropol Regional Court, asking him to consider the cassation appeal.

According to the reply, in December the criminal case was returned for a new consideration to the Yessentuki City Court.

The police initiated criminal proceedings, but the process was…
