High Commissioner achieved reopening case due to newly discovered circumstances

In August, High Commissioner for Human Rights in the Russian Federation Tatiana Moskalkova received an appeal from convicted L. The applicant requested for assistance in reopening the case due to new or newly discovered circumstances.

According to L., in 2015 he was convicted, but during the inquiry the investigating authorities committed numerous violations, in particular, forged the evidence and protocols. As an argument, the man provided the opinion of an independent specialist.

Having familiarized with the materials provided, the High Commissioner sent a petition to the Moscow Prosecutor’s Office.

According to the reply, the applicant’s arguments were taken into account. The circumstances indicated by him in the appeal were not evaluated by the courts of first instance and appeal courts, are new and can be verified only under Chapter 49 of the Code of Criminal Procedure of the Russian Federation.

As a result, criminal proceedings were instituted against L. in the light of the new circumstances; all materials were transferred to the competent authorities for further investigation.
