Volgograd Commissioner takes measures to enforce court decision in residents’ interests

12 April 2017

Commissioner for Human Rights in Volgograd Region Valeriy Rostovshchikov received a collective appeal from citizens, living on Beloglinskaya street in Volgograd, complaining of the illegally built hotel in the neighborhood.

According to the applicants, citizen M. built a four-story hotel instead of an individual apartment house. The new building significantly worsened the living conditions of local residents. The citizens sent complaints to administrative and supervisory authorities with a demand to give a legal assessment of the lawfulness of the erected building.

As a result of the trial initiated by the Volgograd administration, the hotel was recognized as an unauthorized construction object and was to be dismantled at the expense of the owner. However, the bailiffs stood idle, and the citizens had to apply to the regional commissioner.

It should be noted that the enforcement proceedings were initiated in early August 2015. However, as it follows from the materials of the prosecutor’s office, during 2015–2016 the debtor was never called to the bailiff for admission, the measures to levy the enforcement fee and the appointed penalties in the form of a fine were not taken, the decision to limit the right to travel abroad the Russian Federation wasn’t adjudicated.
Having carefully studied the situation, Valery Rostovshchikov took the situation under personal control and intends in conjunction with law enforcement agencies to take all necessary measures aimed at the court decision implementation.

Irkutsk Commissioner helped in restoring applicant's housing rights

15 December 2017

Commissioner for Human Rights in the Irkutsk Region Valeriy Lukin received an appeal from Citizen S. who complained about the eviction from the accommodation which she and her grandmother moved into in 2011 with the agreement of the Irkutsk administration, but without the necessary documents. At that time they occupied the controversial residential premises as fire victims: in 2003 their house burned down, and in 2004 the family was given only a room as a temporary living place. However, in 2017 the Irkutsk administration put forward a demand to S. and her family for eviction from the occupied apartment without providing other housing.
