Dialogue with High Commissioner. Working conditions

The peculiarity of appeals in the area of violation of labor rights is that a successful outcome makes it possible to restore the rights of not only the applicant, but all his colleagues.

Citizen G. addressed me with a complaint about unsatisfactory working conditions provided for the employees of a filling station in Tula.

I sent a request to the prosecutor’s office of the Tula Region. The applicant’s arguments were confirmed. The employer was negligent in complying with the requirements of labor legislation: information about working conditions at workplaces, working hours and rest periods was not documented, there were no personal uniform and safety equipment issuance cards.

Two cases of administrative offenses were initiated with regard to the individual entrepreneur, the owner of the gas station. All the previously mentioned violations were eliminated, the rights of employees were restored.

And here’s another case. Accountant of the sports and recreation complex in Primorye Territory Z. reported that the management of the organization made adjustments to the document defining the procedure for changing working conditions, which resulted in a reduction in the wages of workers.

I appealed to the prosecutor’s office of the Primorye Territory with a request to verify the information. The inspection was conducted jointly with the State Labor Inspectorate in the Primorye Territory.

The applicant’s arguments were partially confirmed. According to the results of the inspection, a new order was issued to change the working conditions (with the cancellation of the previous one), additional agreements to the labor contracts were concluded with the employees.

Every time, violating labor laws, the employer must realize that not one person will suffer from his actions, but a number of them — what will happen if sole breadwinner does not bring home money needed for buying food? If due to the change of labor hours the mother will not be able to spend enough time with her child? If the son is not able to transfer money to elderly parents in another city in time? Some people do not have the opportunity to change jobs, but this does not mean that they have to face intolerable and unlawful working conditions.
